General information

The Personal Data Processing Principles determine the conditions and procedure for how the US Tennis Academy (Tennis School) processes personal data, including personal data received before the Personal Data Processing Principles came into force.

By entering into a customer relationship with the tennis school, by participating in training, the customer consents to the processing of his personal data under the conditions and procedure set forth in these Principles of Personal Data Processing.

The Tennis School has the right to unilaterally change the Principles of Personal Data Processing at any time, based on current legislation. Changes will be notified via the Client's website and/or other communication channel of the Tennis School at least one month before the changes take effect, except in the case that the Tennis School changes the Principles of Personal Data Processing only as a result of changes made in legislation.

Concepts

​

Personal data is any information about the Client and other persons who have applied to the Tennis School, which the Tennis School processes (including the Client's personal data, contact data, transaction data, etc.), as well as information collected from public databases and public channels and information obtained legally from a Third Party.

Processing of Personal Data is any operation performed with Personal Data, including collection, storage, arrangement, storage, modification, disclosure, access, making inquiries and extracts, use, transfer, cross-use, deletion, etc. of Personal Data.

Customer relations are legal relations between the Customer and the Tennis School that arise in connection with being a Customer.

The Third Person is any natural or legal person who is not a Party or a natural person processing Customer Data under the authority of the Tennis School (Authorized Processor).

The tennis school's contact information is the information for contacting the US Tennis Academy (USTA), which is available on the USTA Website.

Parties, the Party is respectively jointly or separately the Tennis School and the Client.

The service(s) are services provided by the Tennis School.

A customer is any natural or legal person who uses or has used the Services of the Tennis School or visits the USTA Website.

General principles of personal data processing

​

Personal data is collected only to the extent necessary to achieve the goals defined in the Principles of Personal Data Processing and the agreements concluded with the Client.

The Tennis School maintains the confidentiality of Personal Data and Processes Personal Data only to the extent necessary to achieve the purposes of Personal Data Processing.

The Tennis School implements appropriate organizational, physical and IT security measures in order to ensure the protection of Personal Data against unintentional or unauthorized processing, disclosure or destruction.

The tennis school employee and other personnel have the right to process personal data only to the extent necessary for the performance of the respective task, following the instructions and legal requirements. The employees of the Tennis School are obliged to keep Personal Data confidential due to the requirements of the legislation and in accordance with the agreements concluded with them.

Personal data processed

​

The Tennis School processes Personal Data that is necessary to provide the Service to the Customer, to fulfill the obligations arising from the Customer relationship and for other previously defined legitimate purposes.

The main Processed Personal Data are as follows:

  • personal data, including name, personal identification number, date of birth;

  • contact information, including address, telephone number, e-mail address;

  • data related to participation in consumer games and campaigns, including data on prizes won in consumer games and participation in campaigns;

  • data on payment behavior;

  • data about the Customer segment related to the Service, including gender and age.

Purposes of personal data processing (for website)

​

Tennis School Processes Personal Data to create and fulfill a customer relationship, to better serve the customer, to make offers, to analyze the use of the Services, to improve the quality of the Services, to develop new Services.

In addition, the Tennis School processes personal data to the extent permitted by legislation in order to:

  • fulfill the contract concluded with the Client or ensure the fulfillment of the corresponding contract and realize and protect their rights;

  • carry out research and analysis of customer groups, service market shares, etc.;

  • check, if necessary, correct and supplement Personal Data;

  • send the Client advertisements and offers of the products and services of the Tennis School and the Third Party cooperation partner;

  • organize consumer games or campaigns;

  • to better understand the Customer's expectations (e.g. analysis of website visits, customer satisfaction surveys, etc.).

Transfer of personal data to third parties

​

The Center may transfer Personal Data:

  • to other companies belonging to the same group as the Tennis School, if it is necessary to fulfill the Customer relationship (providing the Service) or to fulfill another purpose of Personal Data Processing;

  • To persons and organizations related to the provision of services and the fulfillment of the contract concluded with the Client (e.g. payment intermediaries, translation, communication, IT and postal service providers, etc.);

  • Authorized Processors;

  • in case of assignment of the right of claim to a new creditor;

  • In case of financial indebtedness of the client to the debt collection company and the keeper of the default register;

  • to other Third Parties, if the Customer has breached the contract (e.g. to a debt collection service provider).

The Tennis School also transmits Personal Data if it is necessary to fulfill obligations arising from legislation (e.g. transmission of data to investigative authorities, notary public, bankruptcy administrator, Tax and Customs Board).

The Tennis School transmits Personal Data to Third Parties only to the extent necessary to achieve the purposes of Personal Data Processing.

In fulfilling the contract with the client, the Tennis School may use Third Parties (e.g. IT partners, payment center) and make Personal Data available to them. Depending on the circumstances, these persons process Personal Data either according to their own rules and under their own responsibility or as an Authorized Processor on behalf of the Client.

Use of personal data in marketing

​

General and introductory information of the Tennis School Services, notification of changes to the conditions or price list, as well as information related to the performance of the contract concluded with the Client (e.g. information about indebtedness, notification of the termination of the contract, etc.) are not considered offers and advertising. In general, the Customer cannot refuse to receive such information.

Storage of personal data

​

The Tennis School records and stores all orders given by the Client to the Tennis School via Contact Data (e.g. telephone, e-mail), as well as other actions of the Client related to the performance of the Client relationship.

In order to protect the property of the Tennis School and the Client, as well as to ensure the physical safety of the Tennis School's employees and Clients, the Tennis School may use monitoring devices to monitor the Center's premises and their immediate surroundings (including persons) and record the monitoring results. The Center may use the recordings of the monitoring devices to protect the Tennis School's rights and fulfill its obligations, and to prove the actions and/or illegal acts performed by the Client and/or the damage caused to the Center and the Tennis School. The Center or the Tennis School is obliged to transmit the recordings in accordance with the procedure and to the extent stipulated in the legislation, especially in criminal cases to the pre-trial investigation agency, the court and other competent authorities.

Changing personal data and stopping their use (processing)

​

The Tennis School regularly checks (e.g. by e-mail and/or phone, during customer meetings) whether the Personal Data in the possession of the Tennis School is complete and correct. The customer has the right to request the correction of incorrect Personal Data.

The client is obliged to immediately inform the Tennis School of all changes and inaccuracies in the personal data provided.

The client has the right to consult his Personal Data at the Tennis School office or via the Tennis School Contact Data (e-mail usta@usta.ee ). The tennis school allows access to data under the conditions specified in the legislation within 1 month at the latest. Due to the complexity, large volume of the request, etc., the Tennis School may extend the deadline for viewing the data to 3 months. The tennis school complies with the requirements for the protection of personal data when presenting data and may require identification of the Client's identity.

The Client has the right to demand the termination of the Processing of his Personal Data, the termination of disclosure and/or access to them and/or the deletion or closure of the collected Personal Data, if the Client finds that the Processing of his Personal Data is not permitted in accordance with legislation, the contract concluded with him or the Principles of Personal Data Processing. The Tennis School will review the Client's request and respond to it under the conditions specified in the legislation within 1 month at the latest. Due to the complexity, large volume of the request, etc., the Tennis School may extend the deadline for viewing the data to 3 months, complying with the Personal Data Protection requirements when responding to the request, and may require identification of the Customer.

The Tennis School processes Personal Data for as long as it is necessary to achieve the purposes of Personal Data Processing or to fulfill obligations arising from legislation.

Customer rights

​

The customer has the right to:

  1. a) consult your Personal Data and request correction of incorrect data;

  2. b) request deletion or restriction of use of your Personal Data;

  3. c) request the transfer of Personal Data;

  4. d) submit objections to the use of Personal Data;

  5. e) request that no decision be made about him based solely on automated data processing;

  6. f) withdraw the consent given for the use of Personal Data at any time;

  7. g) submit a complaint about the processing of personal data to the data protection authority and the court.

The above-described rights may be limited under the conditions and cases specified in the General Regulation on Personal Data Protection and other legislation.

Protection of customer rights

The client has the right to appeal to the Tennis School, the Data Protection Inspectorate and the competent court if, in his opinion, the Tennis School violates the Client's rights when processing personal data. The client has the right to demand compensation for the damage caused to him by the violation of his rights, on the basis and according to the procedure provided in the Law of Obligations Act.

The Client has the opportunity to contact the Tennis School through the Contact Details if the Client has any questions regarding the Principles of Personal Data Processing or if the Client has complaints related to the Processing of Personal Data.
